This Privacy Policy explains how Performance Digital Solutions, doing business as We Are Performance (“we“, “us“, or “our“), collects, uses, and protects your personal data when you visit weareperformance.com (the “Site“), and the rights you have over your data. We are based in Malaysia, and we handle personal data in line with the Malaysian Personal Data Protection Act 2010 (PDPA). If you are in the European Union or United Kingdom, we also respect the rights the GDPR gives you.

Information you give us
If you contact us through a form on the Site or by email, we collect the information you choose to provide. If you are in the EU or UK, our legal bases under the GDPR are your consent, our legitimate interests, and compliance with legal obligations, as applicable to each activity.
How we share your data
We share personal data only where necessary, and only with:
- Service providers who process data on our behalf to run the Site (see the list below). They may only use the data to perform services for us.
- Legal and regulatory authorities, where we are required to disclose data by law or valid legal process, or to protect our rights, safety, or property.
- A successor entity, in the event of a merger, acquisition, or sale of our business, in which case we will require the recipient to honour this Privacy Policy.

International transfers
Our Site is hosted in Singapore, and some of our service providers (such as Google and Cloudflare) process data in the United States and other countries. This means your data may be transferred to and processed outside Malaysia and outside your own country, where data protection laws may differ. Where we transfer data internationally, we take reasonable steps to ensure it is handled securely and in line with this Privacy Policy.
Data retention
We keep enquiry and contact data only for as long as needed to deal with your enquiry and for a reasonable period afterwards for record-keeping, unless a longer period is required by law. Analytics usage data is retained for a limited period for analysis. We delete or anonymise data when it is no longer needed.
Data security
We take reasonable technical and organisational measures to protect your personal data. However, no method of transmission over the internet or electronic storage is completely secure, so we cannot guarantee absolute security.
Your rights
Under the PDPA, you have the right to:
- request access to the personal data we hold about you;
- request correction of inaccurate or incomplete data;

- limit the processing of your personal data; and
- request that we stop using your data for direct marketing.
If you are in the EU or UK, you additionally have the right under the GDPR to request erasure of your data, to request a portable copy of it, and to object to certain processing.

Children’s privacy
The Site is intended for users aged 18 and over. We do not knowingly collect personal data from anyone under 18. If you believe a child has provided us with personal data, please contact us and we will delete it.
